Notification regarding personal data protection

In accordance with art.10 of [Italian] Law n.675 of 31st Dec 1996 ('Protection of individuals and other subjects with respect to the use of personal data'), hereinafter referred to as the 'law', we wish to inform you that the personal details which you may of your own accord submit to the e-mail address info@otticanet.com or via one of forms in this website will be recorded, used and 'processed' by the firm Star Srl.
For your information, the data processing operations performed by Star Srl and the purpose of such 'processing' are indicated below:
a) Star Srl will collect, record and archive your personal details which you have spontaneously submitted, including your e-mail address. In accordance with the intentions you have expressed, such processing shall have the sole purpose of effecting only an exchange of information and contact details of a commercial nature and that is, for the management of pre-contractual negotiation pending a possible request to make use of the services offered by Star Srl.
b) Processing of your details may also have the purpose of forwarding commercial information and marketing information in general relating to any new services offered by Star Srl unless you express a desire not to receive the same.

All personal data spontaneously submitted by those concerned shall in any case not be communicated to any third party, nor shall they be divulged for the purposes indicated in section b) above (i.e. commercial advertising).

The processing operations and communication referred to above shall occur only relation to common details. The presence of any information relating to racial and ethnic origin, religious beliefs, political opinions, sexual orientation or any other information which may in any way be qualified as sensitive data as per art.22 of Law 675/96 shall result in the immediate elimination of messages containing such data.

In any case the processing operations described above shall occur in compliance with the provisions of art.9 of Law 675/96 and shall be performed both manually and with the aid of data-processing and telecommunications equipment. The data may be kept in hard copy format or in electronic archives so as to permit, when necessary, identification and selection of aggregated data for a time not exceeding the duration and necessity of processing itself. Processing of data shall be carried out directly by the 'Controller's organisation (i.e. Star) with the assistance of 'Processors' (i.e. Star personnel) assigned by him or her to perform such tasks.
The processing shall take place in a manner strictly determined by the purposes indicated and such as to guarantee the security and privacy of the data itself through the adoption of measures suitable to avoid the risk of alteration, deletion, elimination and unauthorised access or processing which is not permitted or non-compliant with the aim of the collection of the same.

Visitors to this website must be aware that the transmission of data via the Internet cannot attain a level of absolute and total security.
Visitors are thus responsible for verifying the correctness of personal data submitted and, if necessary, for correcting and updating it and in any case modifying it during the time it is subject to processing. Star Srl will not consider itself required to perform any operation other than those required to comply with proper and correct application of the standards of security imposed by current regulations.

By sending an e-mail message, those concerned provide their consent and allow their personal data to be processed in the ways and under the conditions indicated i sections a) and b) herein.

In particular and in any case, those concerned may at any time demand that their personal data not be processed for the purpose of advertising, promotion, direct sales, market surveys or interactive commercial communication, either partially or fully, by submitting their objection via e-mail to Star Srl.

For each request ex art. 13, sub-section 1, letter c, number 1 of Law 675/96 Star Srl may ask those concerned, in cases where no data concerning them exists, to pay a small sum not exceeding the actual costs borne by Star Srl, in accordance with the provisions and within the limits laid down by the regulation issued, as per art.33, sub-section 3 of Law 675/96, with DPR [Decree of the President of the Republic] n°501 of 31/03/1998 and subs. modifs.

Art. 13. Rights of the subject whose data is to be processed

1. With respect to the processing of personal data, any data subject shall have the right to:
a) be informed, by having access, free of charge, to the register mentioned under paragraph 1, sub-heading a), of article 31, of the existence of the processing of data that may concern him;
The provisions referred to following sub-heading b) shall be repealed as of the date of entry into force of the amendments to be made to the regulations referred to in article 33(3), in pursuance of paragraph 1, of article 7. b) be informed of what is mentioned under paragraph 4, sub-headings a), b) and h), of article 7;
c) obtain, without delay, either from the controller or from the processor:
1) confirmation as to whether or not personal data relating to him exist, regardless of their being already recorded, and the intelligible communication of such data and their source, as well as of the logic and the purposes underlying the processing; such request is renewable at intervals of not less than ninety days, unless there are well-grounded reasons therefore;
2) the erasure, blocking or transformation into an anonymous form of data which have been processed unlawfully, including those the keeping of which is not necessary for the purposes for which they were collected or subsequently processed;
3) the updating, rectification or, where interested therein, completion of the data;
4) the statement that the operations as per 2) and 3) above have been notified, as also related to their contents, to the subjects to whom the data were communicated or disseminated, except when the provision of such information proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;
d) object, in whole or in part, on legitimate grounds, to the processing of personal data relating to him, even though relevant to the purpose of the collection;
e) object, in whole or in part, to the processing of personal data relating to him which is carried out for purposes of commercial information or advertising or direct marketing, or else for the performance of market or interactive commercial communication surveys, and be informed by the controller, no later than at the time when the data are communicated or disseminated, of the possibility to exercise such right free of charge.
2. Where it is not confirmed that personal data relating to the data subject exist, the latter may be charged a sum which shall not be greater than the expenses actually incurred, for each request as per para. 1, subheading c), number 1), in accordance with the modalities and within the limits set out by the regulations as per article 33(3).
3. The rights as per paragraph 1, where relating to the personal data of a deceased, may be exercised by anyone who is interested in them.
4. The data subject may grant, in writing, power of attorney or representation to natural persons or associations in the exercise of the rights as per paragraph 1.
5. The provisions concerning the professional secrecy of journalists shall further apply as related to the source of the information.
